1. DEFINITIONS

1. INTRODUCTION

1.1 The following general terms and conditions explain the rules of usage and the content of the contract that the customer enters with us.
1.2 While we strive to provide the service we advertise and want to give you the best possible experience, we do so by reacting and responding to the conditions presented with each rental. As we treat every customer as our best client and endeavour to provide the best service we possibly can, we have created these Terms and Conditions to protect both you, the client, and us, PULA TOURS, vl.Anto Lalić, and ensure we are able to offer you the experience we promise.

2. ANNOUNCEMENTS

2.1 Our primary method of communication is email. All requests, confirmations, changes or cancellations must be communicated to the ‘info@pulakayakrental.com’ email address to be considered; exceptions are indicated in 3.2. Communications made outside of this channel may not be considered and may affect your eligibility in other parts of these Terms and Conditions.
2.2 Any bookings and alterations to bookings made over the phone or via VOIP technology must be followed up with a response email on behalf of the client. If this is not possible before the rental start date the client must state this during the call. Bookings and changes may be made to +385 977 636 590 or the Skype handle pulakayakrental.

3. CORRECTIONS

3.1 The customer is obliged to be conscious about his transaction account and all the corrections that are performed. We are allowed to make correction to all mistakes or errors regarding collection of payments, issuance of invoices, calculation of commissions and discounts, and other transactions, including refunds and chargebacks.
3.2 The customer is obliged to announce immediately to us if he knows about mistakes or errors that have been made. Depending on what applies, both parties are responsible for correcting the balance of the transaction account in accordance with the correction that has been made.

4. CHANGES IN THE GENERAL TERMS & CONDITIONS

4.1 We periodically reviews its agreement to the client and may make updates or changes to reflect operating requirements and the responsibilities of us and the client. In the event of changes to the General Terms and Conditions we will notify the client and make available the updated Terms and Conditions. The client must agree to the new terms and conditions before entering into new agreements with us.
4.2 We reserves the right to make changes to the Terms and Conditions without notice.
5. Limitations and Restrictions

6. PAYMENTS

6.1 We offers multiple payment methods, including cash and bank transfers.

7. CANCELLATIONS & SERVICE CHANGES

7.1 Cancellations or changes to service must be communicated as indicated in Section 2.
7.2 We reserves the right to cancel or alter rentals and rental content based on availability, demand, weather or logistical concerns, or due to safety considerations. This may occur with little to no notice to the client, however we will endeavor to communicate any changes to scheduled activities at the earliest possible time. It is our the goal to find the best solution for any changes or cancellations in activities and may offer alternative dates or activities. We will also work with the client on a case-by-case basis for all adjustments and cancellations with the client’s interest and safety in mind.
7.3 The client reserves the right to cancel a rental at any time. Rentals canceled on the behalf of the client are subject to a cancellation fee based on the type of rental booked and a set notice period:

Rentals – Individuals (1 or 2 participants)

• Payment is due in full upon booking.
• Up to 48 hours prior to the rental time, 90% will be refunded.
• Within 48 hours of the rental time, no refund is available.

Rentals – Group Bookings (3 participants or more)

• Payment is due in full upon booking.
• 8 days or more prior to the rental date, 90% will be refunded.
• 3 days – 7 days prior to the rental date, 75% will be refunded.
• Within 48 hours of the rental time, no refund is available.

8. RESPONSIBILITY

8.1 We takes your safety seriously and follows the Standards and Procedures of the „Safety of navigation on the sea and inland waters“.
8.2 We strongly recommends that all clients purchase their own travel insurance to cover unforeseen circumstances arising from vacation activities.
8.3 Subject to our Booking Conditions we are not responsible for any injuries or losses sustained whilst clients are on rentals booked with us, whether conducted by us or a third party.
8.4 The client assumes responsibility for their own property and actions during the rental time.
8.5 The invalidity of individual clauses of this agreement does not affect the validity of the document as a whole.

9. CONFINDENTIALITY

9.1 We may collect personal information about clients to further the service provided. This may include names, email addresses or other identifying information. At no time does we collect credit card information and requires that all payments be made via bank transfer or in cash.
9.2 We may use your email to periodically send newsletters or other information. This may be ceased at any time by replying to the email and requesting that such communications be stopped.

10. DISPUTES & VENUE

10.1 In case of a dispute between us and the client, or those that consider themselves a party to this agreement, and the dispute arises because of these general terms and conditions, disagreement, breaches of the general terms and conditions or the agreement based on them, the venue for such disputes is in the District Court of Pula. 10.2 Croatian laws apply to the relationship between the client and us. With regards to foreign business of the customer that we are handling, the laws of the relevant country apply, unless specifically otherwise agreed upon.

11. CUSTOMER DECLARATION

11.1 By agreeing to this application and these general terms and conditions, the client confirms that he has studied the general terms and conditions for partnership with us in detail and accepts all the content of it without limitations and obliges to adhere to it in all aspects. The client confirms specifically: a. That he has studied in detail and agrees to the general terms and conditions, specifically about our responsibility. b. That the agreement for services with us is entered into in its own benefit only.

  • 1.Can I rent a kayak/ SUP board if I'm a newbie?Yes! Our kayaks/SUP boards are easy to use and incredibly stable. Our experienced staff will give you step-by-step instructions on how to paddle and what to do. You'll quickly find why kayaking and SUP boarding are our favorite ways to experience waters around Pula and south Istria.
  • 2.Do I need to know how to swim?You don’t need to know how to swim, but it's recommended that you do have some comfort and experience when you're in the water.
  • 3.What should I wear?Wear whatever will make you comfortable on the water, given the conditions on the day of your rental. Wearing something that you don’t mind getting soaking wet in is a good idea. Swimwear or board shorts are great options — and water shoes are nice to wear if you own a pair.
  • 4.Can I bring my dog?Absolutely! Bring your dog with you on any kayak or SUP board rental for FREE!
  • 5.What do I get when I rent kayak at PulaKayak Rental?You get brand new kayak, included with paddles, ergonomic seats, dry bag and life jackets. Also, you get FREE on-shore kayaking lesson, safety briefing and local map with paddling routes, useful tips and info.
  • 6.What do I get when I rent SUP board at PulaKayak Rental?You get brand new SUP board, included with life jacket, dry bag, leash and paddle. Also, you get FREE on-shore SUPing lesson, safety briefing and local map with paddling routes, useful tips and info. With inflatable SUP board rentals the staff will hand you the iSUP backpack ready for use.
  • 7.How old I need to be to rent a kayak or SUP board?You have to be adult (18+), and if you are not, you must have a parent or legal guardian present and must give permission for you to paddle by signing the “Rental agreement and Release of liability”. This is standard paperwork that is filled out by every one of our paddlers.
  • 8.What is the “Rental agreement and Release of liability” about?In simple words, after signing it, you accept full responsibility for rented equipment (kayaks/SUP boards and accessories) and agree to pay for any damage, lost or theft. PulaKayak Rental is not responsible under any circumstances for accidents or damage caused to the renter or for accidents or damage which the renter causes to any third party or for cases of liability. For more details, please read carefully our “Rental agreement and Release of liability”.
  • 9.Where is your rental shop?We don’t operate from a rental shop! We are a mobile kayak rental company. Unlike renting from a storefront, when you rent a kayak or SUP board from us we’ll drop your rental at at desired locations in Pula and Istria and pick it up when you’re finished paddling.
  • 10.How does your delivery service work?For short rentals (2 hours), visit us at one of our mobile units and rent your kayak / SUP board. For hourly rentals (2-8 hours), we deliver the kayaks / SUP boards to one of our Drop-off spots around Pula, or at the desired location to the scheduled time. For daily and weekly rentals, we deliver kayaks / SUP boards to the address where you’re staying. We offer delivery service in whole Istria region divided in 5 zones:

    450 Kn 4th Zone (80 km)

  • 11.How I can book the kayak / SUP board?It’s easy, for the reservations in advance, you can send us enquiry using our Reservation form or can be made directly to our Email. We will get back to you within 24 hours! For urgent requests, simply call us with day, time, and location to meet you with your rental.
  • 12.What do I have to bring on drop-off?You should bring with you a valid document (ID, driver licence or passport) for the „Rental agreement and Release of liability“ signing process, full rental amount in cash and an adventurous spirit and a desire to explore.
  • 13.Do I have to leave a deposit?To rent a kayak / SUP board or accessories, PulaKayak Rental require a photocopy of the valid document and a credit card details or a cash deposit in a rented kayak / SUP board value for the duration of the Rental agreement. The deposit will be re-funded if the rented equipment is returned in the same conditions it was procured. The deposit is only required for longer period rental and/or large (4+) number of rented kayaks / SUP bords and/or according to a pre-agreed terms in accordance with the offer or Pro-forma invoice. We are not allowed to take your document as a deposit!
  • 14.What about prices, discounts and payment?Yes, in high season (01.06. – 30.09.) we offer discounts up to 30% on all rentals:

    10% OFF for 4+ paddles rental
    20% OFF for 7+ days rental
    30% OFF for 14+ days rental
    *No cumulative discounts

    In pre & post season you can get up to 50% OFF on all rentals.
    For bigger groups bigger discount!

    Full rental amount has to be paid in cash in Croatian Kuna on drop-off, prices in Euro are approximate just for information. We do not accept debit/ credit cards. For booking in advance we ask you to pay 100% of Pro-forma Invoice amount on our bank account.
  • 15.Do you have cancellation policy?- Cancellations or changes to service must be communicated

  • 16.How can I extend the rental period?Let us know in time and keep paddling! You pay for extra time/days on return, so you can keep the Kayak/SUP boards until you are done with it.
    By the way: longterm renters get a better rate.
  • 17.What if I have damaged kayak/ SUP board?PulaKayak Rental will charge for repairs or replacement of damaged or lost rental and accessories, check Price List.
  • 18.What if a kayak/SUP board gets stolen?Our kayaks/SUP boards are not insured against theft. If your rental gets stolen or you lose accessories, you are responsible and liable for the loss, as per our „Rental agreement“ conditions. If a kayak/SUP board gets stolen you have to inform us immediately and if you have insurance at home which may pay for the stolen bike you will have to ask for a police report at the local police station. PulaKayak Rental will charge the retail value of the stolen rental and accessories, check Price List.
  • 19.What if I'm unhappy with your service?We are not doing you a favor by serving you. You are doing us a favor by giving us an opportunity to do so. Your happiness is our top priority and if we fail, please – let us know, and we would like to help resolve this as soon as we can.
